Terms and Conditions of Use

  1. Acceptance of Conditions
    By booking or using ONE Albania Connect Hub premises and/or podcast room (hereinafter the “Premises”), you (hereinafter the “User”) agree to abide by these Terms and Conditions of Use. If you do not agree with any part of these conditions, you should refrain from using the premises.
  2. Eligibility for Use
    If you are an individual, you must be at least 18 years of age or have the consent of parent or guardian to use the premises. You must provide accurate information during the booking process and ensure that your use complies with all applicable laws.
  3. Free Use
    The facilities are provided free of charge , based on availability. Access is allowed for a limited time and priority will be given to users who have made a prior reservation. Any use exceeding the specified time may incur additional fees , depending on availability and ONE Albania's commercial rates.

The User agrees and is obligated to mention and promote ONE during the development of his activity on ONE premises and in publications on social networks.
The User also commits to adding a “packshot” at the end of each publication, according to the material provided by ONE.

  1. Reservations and Cancellations
    Reservations: Users must reserve the relevant venue in advance through the designated reservation system.
    Cancellation: If you need to cancel or reschedule your reservation, please notify us at least 24 hours in advance . Failure to notify us within this period may result in a penalty or restriction on future reservations.
  2. Rules of Use
    Content recording: Recording content (audio/video) for personal or professional purposes is permitted, provided that the content complies with applicable laws, including copyright and intellectual property rights.
    Prohibited content: Recording, broadcasting or distributing content that is illegal, discriminatory, offensive, defamatory or infringes the rights of others is prohibited . This may lead to immediate expell from the premises.
    Conduct: Users must maintain a dignified and respectful behavior. Any disturbing, harassing or inappropriate behavior will result in expelling from the premises.
    Capacity: The maximum capacity of the Connect Hub space is limited to 30 people .
  3. Environment Use Regulations – The User undertakes to comply with these rules:
  4. Tidy up the environment after the activity – Always leave the premise as you found it (or better).
  5. Take care of equipment and furniture – Treat all objects with care. If anything is damaged, report it immediately.
  6. Put things in their place – After using chairs, tables, and tools, return them to their pertinent place.
  7. Use resources responsibly – Don't waste water, energy, etc.
  8. Report any problems immediately – If you notice anything unusual or dangerous, raise your voice and notify staff.
  9. Respect noise and shared spaces – Maintain a reasonable noise level and respect other users of the space.
  10. No unauthorized modifications – Do not move, remove, or alter furniture, fixtures, or decorations without prior permission.
  11. Be careful with food and drinks – After consumption, clean up their waste.
  12. Be considerate of others – The environment is for everyone – keep it clean, safe, and functional for the community.

 

  1. Equipment and Infrastructure
    • Equipment provided: The premises include basic technological equipment such as monitors, recording devices (e.g., microphones, headphones, etc.). It is the User's responsibility to familiarize themselves with the use of the equipment before the start of the activity. The equipment in the premises is the property of ONE Albania and may be changed in accordance with ONE's policies.
  • Damage to equipment: The User is responsible for the proper use of the equipment. Any damage caused by misuse or negligence will be billed to the User.
  • Maintenance: We strive to keep the equipment in good working order. However, the premises may be temporarily unavailable due to maintenance or technical issues. In these cases, you will be notified 2 days before the date of your event.
  1. Privacy and Confidentiality
  • Data Collection: We may collect personal information from Users during the booking process. This information is used for booking and operational purposes only. It will not be shared or sold to third parties without your consent.
  • Privacy and Personal Data Protection:

If you complete any registration action for an event, ONE Albania sh.a will collect and process your personal data in accordance with the consent you have previously provided for the relevant event.

  • Personal data of participants and/or event organizers:
    All personal data or contact information collected from Participants in an event is voluntarily provided to the Event Organizer or collected in accordance with applicable data protection law. As a participant, you must be informed and consent to the processing of your personal information. The organizers are obliged to respect any restrictions on the use of this information.
  • Recordings and Photographs:
    - Participants are welcome and encouraged to record their experience at the event for personal and non-commercial use (photos, videos, audio), provided that they respect the privacy and comfort of other participants.
    - Participants are encouraged to obtain consent from those who are the focus of the recordings, especially when personal images are included.
    - No use of recordings or photographs for commercial purposes, public distribution or promotion is permitted , without the consent of the Organizer and participants who do not wish to be recorded or photographed.

If a participant is a speaker, he/she and the relevant company grant ONE Albania a national and international, non-exclusive, perpetual, royalty-free license to use, display, reproduce and distribute the speaker’s materials.
ONE Albania will be the owner of the copyright in the recording. Any rights that the speaker may have in the recording are assigned to ONE Albania.

Each event may have official photographers and videographers for promotional and archival purposes. By participating in the event, you agree that ONE Albania may use any footage or recordings in which you may appear.
All rights to this content remain the intellectual property of ONE Albania. You waive any and all claims over their use.

If a participant is a panelist, interviewee or contributor of personal content, he/she grants ONE Albania unlimited and irrevocable permission to use the content (name, voice, image, pre-approved biography, etc.), for the purposes of promotion, publication, distribution, including use by public AI services (chatbot), and any other event platform.

The creation, publication or distribution of content that competes with ONE Albania's official media services for events at One Connect Hub, including written or video media, live or recorded broadcasts, is not permitted.

ONE Albania encourages all participants to show good judgment, consideration, and respect for others and their rights to privacy and comfort.

  1. CCTV Recordings:
    The event premises are equipped with security cameras (CCTV) managed by ONE Albania for security reasons. Authorities may request recordings for certain periods for investigations. These recordings are stored for no more than 30 days from the moment of creation.

  1. Minors
    • Any participant under the minimum age of 18 years is considered a minor and is subject to a special approval process before being allowed entry to an Event held at One Connect Hub .
    The Events are of a professional B2B nature and the participation of a minor in these events is not recommended, except in cases where adequate parental care is lacking.
  • Participants should be aware that an event may not be suitable for minors , due to the presence of large crowds, noise, music and strong visual stimuli (including bright lighting, large screens and demonstrations).
  • Any participant willing to bring a minor due to lack of childcare must request prior approval and written consent from the parent or legal guardian in advance . ONE Albania encourages Event Organizers or Participants themselves to submit any request for the entry of a minor in advance in the case of events organized by third parties.
  • The event organizer or participant bringing the minor is fully responsible for their safety and compliance with all health and safety rules and protocols applicable to the respective event. Participants are encouraged to maintain a professional and non-threatening environment .
  • Confidentiality: Users must take appropriate measures to protect the confidentiality of any sensitive or proprietary information they may record or discuss within the podcast room. The service provider (ONE Albania) is not responsible for any loss or breach of confidentiality.
  1. Limitation of Liability
    ONE Albania is not liable for any direct, indirect, incidental or consequential damages arising from the use of the facilities, including but not limited to loss of data, income or any other financial loss.
    Users are responsible for the security of their devices and data .
  2. Termination of Service
    ONE Albania reserves the right to suspend or terminate access to the premises if the user violates these Terms and Conditions, or if his behavior is considered inappropriate.
  3. Changes to Terms of Use
    We reserve the right to change these Terms and Conditions at any time. Users will be notified of any material changes and continued use of the Podcast Room will be deemed acceptance of the updated terms .

1 4. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Albania . Any dispute shall be resolved under the jurisdiction of the courts of Tirana .

  1. Telecommunications Services
    Network Access: Podcast rooms are equipped with telecommunications infrastructure, including internet access, to facilitate recording and broadcasting. ONE Albania provides this access as part of the free use, but does not guarantee uninterrupted, error-free or secure network access.
  • Fair Use Policy: Users must comply with ONE's Fair Use Policy when using network services. Excessive or disruptive use that affects the quality of service for other users may result in suspension of network access .
  1. Internet Speed and Connection
    Service Levels: The facilities include a standard internet connection provided by ONE. The speed and stability of the connection may vary depending on network traffic and other factors beyond ONE's control. ONE is not responsible for any slowdowns or interruptions in internet service.
  • Streaming and Uploading: Users are responsible for ensuring that their devices and software are compatible with ONE’s internet connection. The service is designed for typical podcasting activities, but bandwidth-intensive activities , such as high-quality live streaming or uploading large files, may experience issues depending on network conditions.
  1. Security and Privacy
    Network Security: ONE will take appropriate measures to protect the security of the internet connection on the premises. However, users are responsible for implementing best practices , such as using secure connections (e.g., VPN or encrypted protocols), when transmitting sensitive or confidential information.
  • Data Protection: ONE is committed to handling user data in accordance with applicable laws and regulations on the protection of personal data. Although measures are taken to ensure data security, users should be aware that the Internet connection is shared and not completely private . Network activity may be subject to security monitoring to ensure compliance with ONE's Data Protection and Information Security policies.

1 8. Bandwidth and Usage Limits
Bandwidth Limits: ONE may impose reasonable limits on bandwidth consumption or data usage on premises. If these limits are exceeded, users may face speed reductions or temporary suspension of access .

  • Shared Network: Users should understand that the internet connection is shared with other users , and the speed or quality of the connection may vary depending on total demand.
  1. Telecommunications Equipment
    Equipment Maintenance: Any equipment related to telecommunications services (e.g., router, modem, network equipment) provided on-premises will be maintained by ONE. Users must immediately report any defects or damage to the equipment.
  • Prohibited Devices: Users can not connect unauthorized telecommunications devices (e.g., external routers, access points, etc.) to the network without prior approval from ONE. Unauthorized devices may be removed or disconnected from the network.
  1. Broadcasting Regulations
    Broadcasting Rights: If the user intends to broadcast or distribute content, he is responsible for ensuring that he has all legal rights and permissions to broadcast or distribute that content via network.
    ONE is not responsible for copyright infringement or unauthorized broadcasting.
  2. Limitation of Liability for Telecommunication Services
    Network Outages: ONE is not responsible for any loss, damage or inconvenience caused by network outages, poor connections or service problems.
  • Force Majeure: ONE is not liable for failure to provide services due to circumstances beyond its control, including but not limited to natural disasters, technical failures or telecommunication network problems.
  1. Support and Troubleshooting
    Technical Support: ONE will provide basic technical support for issues related to the telecommunications network and infrastructure. Any request for assistance should be sent through the designated support channels. Users may need to seek assistance from third parties for issues related to personal devices or software .
  • Support Limitations: Support is limited only to ensuring the proper functioning of the telecommunications infrastructure . ONE does not provide detailed support. for the user's podcast content, recording setup, or other non-network related technical issues.
  1. Changes to Services
    ONE reserves the right to modify, suspend or interrupt telecommunication services , including internet connectivity, without prior notice , in particular for reasons of network improvements, maintenance or regulatory requirements.
    Users will be notified as soon as possible in the event of changes to the service.
  2. Use of Appropriate Language and Content Guidelines

24.1 Use of Appropriate Language
Users of the premises are required to use appropriate language when presenting, recording or broadcasting content. This includes, but is not limited to:

  • Prohibition of Hate Speech: Users must not engage in or transmit content that incites hatred, discrimination, racism or intolerance towards any group, individual or community.
    Prohibition of Offensive Language: Foul, offensive or inappropriate language is strictly prohibited.
    Respectful Communication: Users must ensure that their language and content are respectful and considerate of others in the podcast room and any potential listeners.
    Compliance with Law: Content recorded or transmitted must not violate any applicable laws or regulations, including those relating to defamation, harassment or obscene content.

24.2 Content Monitoring
Although ONE does not actively monitor or edit content , it reserves the right to intervene if content violates these guidelines. Any content deemed offensive or inappropriate by ONE may result in immediate termination of access to the premises, without prior notice.

24.3 Non-Publication and Removal of Content
ONE, in its sole discretion:

  • decides whether or not to publish the content created in the premise.
  • reserves the right to remove any content that violates these language and content guidelines or that has been reported as inappropriate.
    Users will be notified if their content is unpublished or removed .

2 5. Non-Competition Clause

25.1 Non-Compete Agreement
Users agree not to engage in any activity that directly competes with ONE's services, during the use of the premises and for a specified period thereafter. This clause includes:

  • Content Creation and Commercial Podcasting: Use of the premises to create, develop or broadcast podcasts or other media that directly compete with ONE’s services, platforms or offerings is prohibited .
    Telecommunications Services: Use of the premises for projects that compete with ONE’s core telecommunications services , including the provision of internet, data transmission or other related services is prohibited .

25.2 Duration of the Non-Compete Restriction
This clause will be in effect for a period of 3 months from the last date of use of the podcast room . This period may be extended or shortened, depending on the nature of the content and ONE's competitive market.

25.3 Geographic Scope of Application
This non-compete clause applies within the territory of Albania , where ONE provides its services and has competitive interests. Users agree not to engage in competition in any area where ONE operates services, for the entire duration of the restriction.

25.4 Exceptions
ONE may grant exceptions to the non-compete clause , but only in writing . Any user wishing to engage in activities that could be considered competitive must seek written approval from ONE before proceeding.

25.5 Consequences in Case of Breach
If it is found that a user has violated the non-compete clause, ONE may take appropriate measures, including:

  • Immediate termination of the user's access to the environment.
    Legal proceedings for any damages caused by the violation of the non-compete agreement, including claims for loss of revenue, competitive advantage and other related damages.
  1. Miscellaneous Provisions

26.1 Changes to the Terms
ONE reserves the right to change or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting and users are responsible for periodically reviewing the terms.

26.2 Enforcement of Terms
Failure by ONE to enforce any part of these terms does not constitute a waiver of the right to enforce them in the future.

  1. Compensation

This provision stipulates that users agree to indemnify ONE from any legal liability that may arise from the use of the podcast room.

27.1 Indemnification
Users agree to indemnify and hold harmless ONE, its affiliates, employees and representatives from and against any claims, damages or expenses arising from the use of the Podcast Room, including but not limited to:

  • Violations of the Terms of Use.
    Violations of third party rights (such as intellectual property rights).
    Legal violations such as defamation, harassment or invasion of privacy.
  1. Force Majeure

This clause addresses exceptional situations that may prevent ONE from providing services.

28.1 Force Majeure
ONE shall not be liable for any failure or delay in performing its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to:
natural disasters, strikes, government regulations, telecommunication network failures or terrorist acts.

  1. Accessibility and Special Needs

This section ensures that users with disabilities have equal access to the podcast room.

29.1 Accessibility
ONE is committed to providing accessible services. If you require special equipment or assistance using the podcast room, please contact us in advance , and we will do our best to fulfill your needs.

  1. Termination of Use

Cases are specified when ONE or the user himself can terminate access to the facility.

30.1 Termination by ONE
ONE reserves the right to suspend or terminate a user's access to the premises if:

  • The user breaches these Terms and Conditions;
  • There is evidence of illegal activity or misuse of the premises;
  • ONE assesses that the user's actions harm or disturb other users .

30.2 Termination by User
Users can terminate the use of the Facilities at any time by notifying ONE. However, any unused or uncancelled time is not refundable .

  1. Intellectual Property
    If the premises are used to create intellectual property (such as podcasts, videos or other content), the parties agree to the following:

31.1 Ownership of Content
Users retain ownership of the content they create while using the Facilities. However, by using these Facilities, Users grant ONE a non-exclusive, royalty-free right to use, promote or distribute such content for marketing or promotional purposes.

31.2 Copyright for Content
Users are responsible for ensuring that the content they create does not infringe the intellectual property rights of third parties. This includes equipment with appropriate permissions for the use of music, logos or other copyrighted materials.

  1. Dispute Resolution and Governing Law

32.1 Dispute Resolution
Any dispute arising out of these Terms and Conditions will first be attempted to be resolved through informal negotiations . If a resolution is not reached, the parties agree to pursue the mediation procedure before taking legal action.

32.2 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Albania.  Any legal action must be brought to the courts of Tirana .
